These terms and conditions are applicable to all our online
services and apply to all reservations, bookings and arrangements for
accommodation. By accessing, browsing and/or making use of our Website, whether
for general browsing or for the purpose of effecting, completing or confirming a
reservation, you acknowledge and agree to have read, understood and assented to
all the terms and conditions set out below including the privacy policy
statement hereby incorporated within.
These terms and conditions may be subject to amendments from
time to time to be determined entirely at the Hotel’s discretion and which will
become effective upon publication on the Hotel’s Website. The Hotel shall not be
obliged to furnish any prior notification of the said amendments.
All content and material contained in this Website are the
copyrighted property of Milano Due Limited. No material from this Website may be
copied, reproduced, republished, uploaded, downloaded, monitored, transmitted or
distributed in any way and are strictly provided for your personal,
non-commercial use only, subject to the terms and conditions set out below. The
Customer is further strictly forbidden from using any tools, applications,
programs or robotic algorithms to download or ‘spider’ the Website or any of the
pages of the Website.
Section 1. Definitions & Scope
1.1. Definitions
Under these General Terms and Conditions, unless the context
provides otherwise:
‘Hotel Milano Due’
means the Hotel Milano Due, 113, The Strand, Gzira, GZR 1028 Malta.
‘Customer’ means a customer
who reserves and/or books one or more services offered on the Website.
‘Website’ means the
www.milanoduehotel.com website.
‘Service’ means a service
offered online through the Website.
‘General Terms and Conditions’ means these general terms and conditions for booking and use,
as amended from time to time.
Where the definitions above appear in the singular they shall
include the plural, and where such definitions appear in the plural they shall
include the singular; unless the context shall provide otherwise.
1.2. Scope
These General Terms and Conditions apply to online booking
and all ancillary services made available by the Hotel courtesy of the Website.
It is the sole responsibility of every Customer to read and
acquire a firm understanding of these General Terms & Conditions and the Hotel
shall bear no responsibility for any misunderstanding or confusion resulting
from a lack of familiarity of these terms and conditions on the part of the
Customer.
These General Terms and Conditions may be amended, altered or
modified at any time without the need of furnishing the Customer with prior
notice thereof, although any such amendments, alterations or modifications shall
not operate to the prejudice of any orders already effected and accepted by
Hotel Milano Due.
All visual imagery displayed on the Website does not
necessarily represent the exact room which the Customer would be accommodated in
during the course of his/her stay, which room may vary in respect of dimension
and location within the Hotel Premises.
Hotel Milano Due does not provide any warranty or guarantee as to the
accuracy, timeliness, performance or completeness of the information and
materials found or offered on this website for any particular purpose. The
Customer acknowledges that all such information and materials may contain
inaccuracies or errors and the Hotel expressly excludes liability for any such
inaccuracies or errors to the fullest extent permitted by law.
It is therefore absolutely essential that the Customer read
the General Terms and Conditions at the time the booking is placed, in order to
be aware of the provisions in force.
Section 2. Online Reservations
2.1. The Website
The Website
www.hotelmilanodue.com is designed to guide the Customer in making an online
reservation successfully and to facilitate easier access to all necessary
information which is of assistance to the Customer.
The Total rate for the full stay shall be charged immediately
upon confirmation of the booking, which rate shall be charged to the Credit Card
indicated by the Customer, details of which shall be provided to the Hotel by
the same Customer. .
In order to make an online reservation the
Customer must be at least 18 years of age, be legally authorised to enter into
contractual obligations and must use the Website in strict accordance with these
General Terms and Conditions. Minors are not authorised to make use of any of
these services.
The Customer is financially accountable for his / her
activities on the Website, including the possible use of his / her customer user
name and password. The Customer guarantees that the information entered by him /
her on the Website in relation to him / her and, where applicable, his / her
traveling companions to be truthful and accurate.
Hotel Milano Due reserves the right to refuse, limit or
withdraw entirely any of the services provided online courtesy of this Website
to any Customer where there exists reasonable suspicion that any fraudulent or
unlawful use has been made of this Website or where such use operates counter to
or is in clear violation of these General Terms and Conditions.
2.2. Availability
All online reservations are taken and confirmed at the
discretion of the Hotel and are subject to availability and to an adequate
allocation of rooms. If maximum allocation of rooms is attained then the Hotel
will be unable to, during the period in which the maximum capacity for that
particular allocation subsists, accept any additional reservations, even though
the Hotel may not be fully booked. Rooms and rates may be unavailable or
restricted at certain times or during certain seasonal periods.
2.3 Confirmation and Cancellation of reservations.
2.3.1 Confirmation
Upon confirmation of a booking by the Hotel, the Customer
shall receive by e-mail, which e-mail is to be sent prior to the Customer’s
arrival, confirmation of the said booking accompanied by all essential
information illustrating the specific details of the accommodation purchased and
all other information relevant to the Customer’s stay at the Hotel. .
It is expressly agreed that the data stored in the
information systems of Hotel Milano Due shall constitute proof with respect to
the reservations made by the Customer. Data stored in computers or electronic
media are to serve as valid proof, and shall therefore be acceptable under the
same conditions and with the same probative value as a physical written
document.
2.3.2 Cancellation
Any Cancellations of reservations are to be submitted by
e-mail to
reservations@milanoduehotel.com up to 3 working days before the date of
arrival.
In the event of the cancellation of the booking contract by
the Customer; prior to the stipulated days above, a cancellation charge of 10%
of the total cost of the booking shall be applied to cover banking,
administrative and handling fees.
Should the Customer elect to cancel his/her reservation after
the days stipulated above, cancellation charges would amount to the full value
(100%) of reservation, with the direct consequence that no reimbursement to the
Customer is to be made.
No refund shall be due to the Customer in all cases where the
Customer fails to check-in on the date of arrival.
2.3.3 Change of booking
If after making the reservation the Customer wishes to
adjust, change, modify or review his/her reservation with respect to the dates
of travel the Customer is required to e-mail
reservations@milanoduehotel.com,
and a standard amendment fee may be charged in respect of each change requested
and so granted. Where a change affects more than one person on the booking, an
amendment fee will be applied in relation to each person. Changes to a
Customer’s booking dates may render necessary a conversion to a higher room rate
depending on the period/type of room/number of persons in which he/she may opt
to change.
2.3.4 Reimbursements
In the event of a refund to the Customer after the above
deductions, the relevant amounts will be transferred back to the payment card
used to reserve and confirm the original booking. Any booking charges applied
will not be eligible for reimbursement.
2.3.5 Force Majeure
Hotel Milano Due cannot be made to accept liability or pay
compensation where the performance and/or prompt performance of the Hotel’s
contractual obligations to the Customer is prevented, impeded or adversely
affected by "force majeure".
Under these terms and conditions the term "force majeure"
means any event which is of their inherent nature unforeseeable, even where a
reasonable level of due care and foresight is employed. Such events shall
include but are not limited to situations of war or the threat of war, civil
strife or instability, riot, industrial dispute, terrorist activity, natural,
chemical or biological disaster, fire, adverse weather conditions, and all
similar events beyond the control of Hotel Milano Due.
Section 3. Privacy Policy
3.1 Personal information collected
This Private Policy Statement (hereinafter referred to as the
‘Policy’) is to constitute part of these terms and conditions governing the
Customer’s use of Hotel services as offered through the Website. By using the
Website to book his/her stay at Hotel Milano Due the Customer hereby consent to
the use of his/her personal information in strict accordance with the local
laws.
Hotel Milano Due acknowledges that confidentiality is of paramount
importance and is committed to safeguarding the privacy of all personal
information provided by the Customer during the course of making an online
reservation. The Hotel shall ensure that all personal information furnished by
the Customer shall remain secure and confidential, save under those
circumstances where a disclosure of information is required by operation of law.
The Hotel also reserve the right to retain Customer
personal information collected and to process such personal information where
necessary in order to comply with accounting, fiscal and tax
rules and regulations and any specific record retention laws.
For the purposes of this Private Policy the term ‘personal
information’ shall cover all information which identifies or which is capable of
identifying the Customer.
The Hotel reserves the right to collect, solely for purposes
of processing online reservations for accommodation, the following personal
information:
- Customer’s name, nationality, residence,
occupation, passport number, contact details (telephonic, electronic & postal)
and where applicable all information pertaining to any visa issued.
- Guest stay information, booking details,
dates and time of arrival and departures, goods and services purchased requests
for any of the Hotel’s services on offer and use of Hotel facilities.
Hotel Milano Due or any of its employees shall not be storing
or handling any Customer’s Credit Card details save where such information is
required in order to accept and confirm the Customer’s online reservation.
3.2 Cookies and Other Web Technologies
The Hotel reserves the right to make use of ‘cookie
technology’ whenever a user visits the Website, which use shall be solely geared
to improving and enhancing the functionality of the Website and which shall not
be used to reveal or disclosure in any manner user identities.
The cookie file will not reveal the User’s identity but will
indicate his browser upon accessing the Website. Every time the User of Customer
visits the Website, the Hotel’s Web Server will recognize the cookie file
whereby the Hotel will be able to offer the User or Customer consistent contents
already set or adapted to the user’s previous preferences and settings.
The Hotel shall be permitted to send a previous Customer by
e-mail any promotional offers which the Hotel shall be offering from time to
time only once the Hotel has been specifically authorized to do so by the
Customer.
Section 4. Credit card
For the purposes of guaranteeing your online reservation the
Hotel Milano Due requires credit card details in order to process and guarantee
your reservation and charge the credit card with the relevant booking costs.
Completing a reservation on our Website indicates an
acknowledgment on the part of Customer that he authorizes the Hotel to charge to
the credit card all relevant booking costs of the reservation, booked and
purchased online.
Section 5. Governing Law
These General Terms and Conditions shall be governed by and
construed in accordance with the substantive laws of Malta.
In the event of any disputes, disagreement or controversy
arising out of or related to the interpretation of these General Terms and
Conditions all actions are to be instituted and determined
before the Maltese Courts who shall have sole competence and jurisdiction to
hear and determine such an action.
Section 6. Miscellaneous
These Terms and Conditions constitute the entire agreement
between the parties relating to the use of this site. If any provision of these
Terms and Conditions is deemed void, unlawful, or unenforceable for any reason,
then that provision shall be severed from the rest of the terms and conditions
and shall not affect the validity and enforceability of any of the remaining
provisions.
